I still think, the USA is the best place for democracy loving people. Govt and its agencies try their best to be accountable to law. Now if you want our Immigration issue to be put before IRAQ in the Congress, I would think that is selfishness. I have colleagues whose sons are in IRAQ. For me their lives are more important than my GC. Now that does not mean we stop making our point to Congress.

Dr. Emilio Gonzalez responded to such flower campaign in the USCIS site. The flower campaign appears to be a gesture from the community of foreign professionals to thaw out the tension created by the fiasco and at the same time calling the agency leaders' swift attention to the problem and sufferings of the foreign professionals and their family members. This camapaign has been initiated and pushed ahead by the immigrationinvoice.com group. Salute to the members of this group for the job well done.

we all are law abiding individuals who pay taxes like any other citizens.
We are only trying to highlight our plight as they say
"Only a squeaky wheel gets a grease."
No can deport or arrest you by taking out a rally.
Wake up guys. Lets get together and be unified as only then can we be heard.
We all are well educated peaople and we don't need to be treated like slaves.

Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always �current�. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 �ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.
Numbers made available from AC21 was the only initial reason to become current. Later after 2001-Sept until 2002- October ( TSC until March 2003) no EB I-485 were approved. Ok, i will try to make it as simple as possible:
2 guys (names - JE and MBA respectively) graduate with BS in Engineering in 2001.
Both go to USA in 2002.
JE goes on H1B (as Junior Engineer) while MBA goes for an MBA on F1.
In 2003, JEs company files for his GC, PD 2003, EB3
In 2004, MBA graduates and joins a company as a manager.
In 2005, MBA's company applies for his GC in EB2, PD 2005.
So far so good.
Now, it is 2008. Both are still waiting for their GC.
Ideally, both are in same position (they should be, as both have same amount of exposure to professional world after undergrad - one replaced the work experience by higher degree and vice-versa).
Now, JE wants to port his PD and get into EB2 category with PD 2003. This will make him exactly 2 years ahead of MBA. If he doesn't port, they are approximately in the same situation, so the chances of them getting a GC in 2009 will be same.
What do you think is fair?
P.S. - I do not support this lawsuit.

I was able to contact NSC using POJ today. Got same response- File is with IO for review.
I could reach IO yesterday. representative said that me and my wife's cases are preadjudicated. Not sure if I could believe this...

On what basis you are saying that Oct'2008 PD will be similar to Jun'2007. Didn't you read the note in Sep'2008 VB that PD for EB3 category will retrogress further.
If you cann't support EB3 community then at least don't misguide people here. EB3-I is in severe pain right now and people like you can't understand it.

Hello Everyone
We had our visa interview for H1-H4 stamping on Jan 29 in Mumbai Consulate as my hubby had changed his employer and also applied for the 3 year extension.The VO asked him questions about his job,company,profile ,etc and told us the visa was approved and we will get it in mail the next day.We got our passports with new visas the next day.I don;t know about others in our line cause we were the first one's there.
Am not sure how the PIMS thing works if it is for every one or only some ppl.

hi mamit, is this yourfirst time H1B or renewal..and are you doing anything to help this situation ?? like calling what nymbers ?? and did they tell you it was TAL and were you told why the delay is ??
This is my first H1-B visa. I was in USA on an F-1 before that. To be honest, I was thinking that it'd take about 7-8 weeks for this matter to solve as I was also told numerous times when I talked over the phone with Delhi consulate people. Saw this forum yesterday, and had no idea that the system in US would be this ridiculous. And no they didn't tell me it was TAL, they only said "administrative processing" and gave me a pink slip. I did call the National Visa Center in USA yesterday, but my prepaid phone died before I could get any relevant information. Will call them again soon and will post here about it. So during this whole time, I was only calling Delhi consulate and checking status online at Delhi consulate's website. Now when I read all these posts about delays here, I am a little afraid now. One my friend in US told me to talk to my boss (in US) and have him call local senator/congressman write a letter to DOS. Has anyone ever heard of such thing or done anything like this? Is is a good idea?

I do not want to spoil the fun and do truely appreciate the efforts by the IV team. But after sitting in the GC queue for 7 years, all my hopes nearly dead. Campaigns come and go but nothing ever happens.
