My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware/expecting many of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .
Yes, I am of the same opinion. USCIS wants to stop the premium processing for I-140 only because it anticipates large volume for I-485. I don't see why it would stop the cash-cow (premium processing) and stop taking I-485s too!!!

It is received date stamp, what they do after receiving. They do it immediately on the same day.

I am on a h1b currently. I changed empoyers in the US but the old stamp is still valid till semptember 2008. I has taken a visa date for jan30 in mumbai consulate and was going to fly back on feb9. Now planning to cancel the visa stamping because of the PIMS delays. I hope i am still valid to fly as i have a valid visa stamp and a new petition from current employer too which i can show at port of entry. Do let me know your views on the same and if there are any probable issues....

I am trying to find out if filing a DHS-7001 has actually resulted in resolution of the approval for anybody. i see a lot of folks requesting an ombudsman to intervene but wasn't sure if anybody got a positive response back -- like the case is now resolved or something.

Some IV members were in DC at USCIS building yesterday (Tuesday, July 10th, 2007) from 10 AM to 1 PM. There were reporters there including CNN-IBN and Voice of America (Aaj Tak chanel) with video cameras. We saw the deliveries of flowers being made by UPS and FedEx. The DHL guy told the flowers were already delivered in the morning in the big truck. The security guards at the loading dock of USCIS were not allowing Video Shooting after the reporters shot the UPS deliveries going inside. When the FedEx tuck came in, they made him park right near the Loading Gate and were trying to cover up by parking two other vans each side of that truck so nobody can shoot the delivery.
Then IV members went inside the USCIS building from the main gate to hand deliver the flowers with Get Well Soon ballon and card for Emilio Gozales. Teh Video cameras followed until the security guard asked them to stop the recording as they didn't have prior approval. The security guards, receptionists and people around were smiling by seeing the flowers for Gonzales. They let the IV members proceed towards the visitor area. Where another secuirity guard asked who the delivery was for and directed to one of the Gonzales's secretaries, Rachel, who accepted the flowers. There were people around her. Rachel said to them "This is creepy, as far as I know he ain't sick, we received flowers last week, they were pretty too. Yesterday someone sent him cookies. This is some kind of peaceful protest". Then she also read the card in front of IV members. IV members asked her about the website update which says they are sending these flowers to Walter Reed. She said yes, we are doing that. IV members thanked her and left the building.

They made them wait and then several people (from different level of securityty to management) came to talk with them and finally said they can not allow to shoot for security reasons. Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

"Many people are in your scenario.
There are many ways to do this. Each one being a little more expensive then others.
What can be done:
Your wife files as primary and you secondary on her 140.
You file as primary and her secondary on your 140.
Option #2
You file alone on your 140
She files alone on her 140.
Somehow if the dates should move backwards and her 140 on labor substitution should get denied (you never know with labor sub); then for her to file on your 140 the date has to be current or she canʼt file until it becomes current.
You and her just file on her 140. Problem is if the 140 gets denied then the window of opportunity to file the 485 again may not be for a couple of years.

If you want to be safe and want to spend more money then she would file as primary on her 140 and you as dependent. Then at same time we would file you as primary on your 140 and her as dependent on your 140.

"It is not possible for you to be her derivative as well as your own primary, and vice versa. It would require the filing of 2 I-485s and this causes nothing but confusion on the part of the USCIS. You have 2 choices. You could pick a case that you are going to proceed under, most likely the one with the earliest priority date, so long as there is confidence that the I-140 will be approved. Or, you can hedge your bets by each filing as your own primary because if one of the cases falls into a problem, the person can switch to be a derivative, but could run into a problem if there were not current priority dates at the time. But, so long as your both remain in H-1B status, and not use EAD/AP, that is minimized"

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

This trend chart/volume chart certainly represents both family and employment base applications. Following is my thought process now with keeping both trend chart and teh worksheet in this thread chain together.
(1) In Worksheet USCIS claims total EB pending case 233816 by December 2009. Yet we
have not reached to December 2009. Trend chart claims total pending 279031
including family base applications. Since famaily to EB ratio is unknown I would
consider worksheet's figure as authentic for pending EB based 485 cases. One practical
clue for inclining to do this as I know USCIS has approved tons of green card in
parental family category. Many of my friends have got GCs for their parents in a
relatively very small time frame - 1 year
(2) I remember somehow that out of 775000 485 applications in October 2007, there were
around 300000 application were from EB category based on USCIS's published
notification ( I tried to find it on internet but some how I do not see it now). If
somebody has a more solid proof this stats from which we can derive nearly accurate
ratio we may consider those stats. But as I mentioned in point 1 USCIS seems to have
cleared more family bassed 485 with comparison to EB categories I would just
assume for now that 60% preadjudicated cases and "awaiting customer action"
and "New receipts" are from family category and 40 % are from EB category. Total
preadjudicated cases per trend chart is 178418. 40% of that around 71367 - for the
sake of easiness let's make it 71500. This way "awaiting cutomer action" cases for EB
categories could be around 18-19000. "New receipt" cases could be around 18000
roughly.
3) Now total EB based 485 cases by July 2009 could be = Pending cases + preadjudicated
cases + cases awaiting customer action + new receipts = 233816 + 71500 + 18000 +
18000 = 341316. Just the sake for simplicity in assumption we may consider total EB
based 485 workload with USCIS around 350000.
4) "In general" the first lot who will come out from this gutter is "preadjudicated" then the
lot "awaiting customer action" then the "pending ones" and then " new receipts"
Now based on my talk with USCIS guy I can state that USCIS generated RFEs innear past for many cases as apart of preadjudication process, particualrly for may AAC21 usage related cases - Asking for proof of employment in the same job classification. According to that talk if USCIS gets required response to the RFE then USCIS settle that case in a "preadjudicated" shelf. My attorney is not including any w2s/tax returns at all. According to her, their firm never files these documents and got many approval without any issue. Did you see any instructions in 485 forms that says that they are required?
W2's/tax returns are not part of the initial evidence USCIS requires to process your application but they may ask for it later if required

did they keep your possport with them? If yes, you can't even come back on Advance parole?

We have learned that in all probability House Judiciary committee will finishing marking up HR5882 in the next committee meeting. The bill is likely to be brought to the House floor the following week. We have been told that if our bill(s) pass the House, Senate will include the language of the bill(s) in another Senate bill that has majority support. We must admit that the time is shot but its still possible.
We request everyone that starting monday, please call all the members of Judiciary committee. Thanks to the members who have already made phone calls to the lawmaker's office. We request you to please call again to show your support starting Monday.

if she applied for H1B the first package the lawyer sumitted should have copies of her I-20 and EAD. Look through the package you may find a copy in it.
i think the card was mailed directly to us
