Most of the hype is being created by the immigration law firms and attorneys, rather than DOS or USCIS. They are after the dough!
The news might just bring relief to many people, but look at who is creating the most of the hype - it's attorneys.
The comments in this update kind of seem contradictory to me. It says that there might be possibility for greater advancement than earlier thought... and then they talk about moving it back.
Whatever it is..I don't know why they are creating so much publicity about this bulletin. Does it mean they are going to advance the dates by a couple of years??? If it was for a few months why would they create so much hype about this?

eb3_nepa,
The whole idea of this campaign was to get media attention and publicize this issue as much as possible, which we all know that it did just that quite effectively despite all the apprehensions and reservations expressed.
This campaing was never thought of as a panacea for all our problems, whether it will lead to a fruitful or POSITIVE result that is still unknown. What is known is that this drive has provided some much needed traction and attraction to our cause, which is the important RESULT at this point in my opinion.
All I am trying to say is that we should give some thought and imagination before discounting or discarding an idea even if it appears to be far fetched at first. Any idea proposed which is out of the ordinary will be meted with reservations and oppositions, after all its nature's law that there is always resistance to change, good or bad.
I don't want you to be eating your words :D , I know for sure that you want this problem resolved as much as anyone else on the forum.:D
Everyone has right to be SKEPTICAL and even I am SKEPTICAL about the final outcome of our over all struggle, but I wasn't SKEPTICAL about the outcome of this campaign.
May the force be with you.:D
Yes I was the one who suggested the dead fish. I belive in RESULTS, if sending these flowers actually ACHIEVES something, I will make a nice big biscuit of my words and eat them :).
Until we see ACTUAL "POSITIVE" RESULTS I am still going to be skeptical. Sure we have made a lot of noise and it has been heard by a lot of miscallaneous people. So were the rallies held by the illegals. What happened? NOTHING! So until I see some results YES I will STILL be skeptical.
Other than that, I really really really hope for everyone's sake, that this works and if it does I will eat my words and become a believer:)
So much for being mum eh ;)

Hi,
I was scheduled to travel outside US this summer for about 3 months. Then dates move past my PD and I have to apply for 485 in june. I have discussed these with the lawyer and want to confirm what she is telling me:
1) I have to be in the country to apply for 485.
2) FP notice will likely arrive in 3-4 weeks. But we have 84 days to reschedule this if needed.
3) I was not planning on applying for EAD/AP at this time. However, she says that if I leave the country on H1, and 485 is approved while I am out of the country (HIGHLY unlikely but still possible), then I cannot come back into the country unless I have an AP. (This is the point that I mainly need clarification on!)
4) If I DO apply for EAD/AP then I cannot leave the country until they are approved.
5) Finally she cannot give me a timeline for how long EAD/AP would take. The service centers processing times show that they are currently processing Jan cases. Which means at least 4 months wait after applying for EAD/AP.
Does any one know if any of the first four points are wrong. If so, what is your knowledge about the point that is wrong. Also, does anyone have any idea on point 5 (i.e. how long it is taking for EAD and/or AP these days).
If you have any information, please respond ASAP, so that I can determine the best course of action before filing for 485.

They are referring to the Perm Labor data for year 2009.
I think one common mistake that is being made everywhere on this board since the USCIS data got out is to make assumptions on demand. We are only being shown data which shows pending applications from USCIS. If USCIS releases data of how much demand by priority date they were getting then its a different thing. When you say , are you basing that on this data released by USCIS or on something else. Because if you are then you are probably wrong. This data only tells you pending data as of Aug 2009 by priority dates. It could well be the case that USCIS got a lot of volume from Sep 2007 to Aug 2008 and processed them all and hence pending is less now. Hope you understand. The only way you can do it with some degree of success with current public data is by looking at PERM Filing data.

Should your address showing up on your w2 and pay stub be matching with the address of your parent company that filed your LC for Permanent Residence? My parent company that filed for my GC is in MI and so my Labor was also filed from there and currently I am working in IL and have been filing tax return for the state of IL for the last 3 years. The addres that shows up on my pay stub and w2 is for the state of IL. As my I485 is already filed so would it matter at the time of adudication of I485 about this address issue?

Rodnyb,
The below number is depressing, however dont you think DOS/USCIS always believe in keeping buffer and they may push the dates somewhere into 2009 just to accept 485 filings?
Why do think they will stop keeping any buffer?
[QUOTE=rodnyb;2494192]Teddy, I agree some of your data. Mine would be (90% confidence level)

I think you have a good case here....I really don't see why they can't hire EAD's. Especially because it is 'discriminatory' as per regs to do so. If the reason is something else, then they should say so.
Maybe they just want you to sue them and then declare bankruptcy..with all their sub-prime credit card exposure, they must be in bad shape..

They look for criminal hits, why do they care about foreclosure or credit history. The scope is to look for undesirable elements who are a National Security risk. It has nothing to do with credit history.
The sad part is that we have no criminal history and we still get stuck because of a problem with their process, there is no recourse, you can write to any one you want. WOM can work but thats about it...if people continue filing WOM they might come up with something else to block WOMs too. The term 'national security' is pretty powerful, credit history would mean that half of this country would not be eligible to stay here
Would appreciate if anyone can reply to my question....

It is going to be true. otherwise mathew wont shut down his work and post that AILF is going file law suit.
I am suspecting that they made current because of lobby made by some big heads inorder to get support to pass the immigration bill.
Since the immigration bill failed, DOS is going back to retrogression.

Guys,
I have heard from friends that if after 90 days of applying you don't receive an EAD card, you can walk into a local USCIS office and they will issue you an EAD. Is this still true? If yes, what documentation do I need to take with me? Its been 2 months since I applied. Anybody know how long it is taking from NSC?
Thanks

Specter And Frist Eyeing Each Other's Immigration Efforts
Signaling that the immigration issue faces a tough fight, the Senate Judiciary Committee is planning to produce a wide-ranging bill, while Senate leaders are poised to write their own legislation. A senior GOP leadership aide said Majority Leader Frist is operating on "two tracks" on immigration, waiting to see what the Judiciary panel produces "while being ready to act in lieu thereof to meet member interest of action on this bill."Judiciary Chairman Specter sounded confident that his panel would produce a bill that would wind up on the Senate floor. "The idea of having a leadership bill ... has been abandoned," he said last week. His panel will begin marking up immigration legislation March 2. A chairman's mark expected to be introduced this week will resemble the mark Specter circulated last year, which borrows components from various immigration proposals. It included the border security provisions in the plan introduced by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., as well as the guestworker plan introduced by Sens. John McCain, R-Ariz., and Edward Kennedy, D-Mass.
Specter has characterized the mark as a "starting point" for debate.
Frist has told colleagues he wants to begin floor debate in late March, likely March 27. Senate aides said whether the bill will be written by the committee or leadership depends on how the Judiciary Committee markup goes. "If the committee keeps the bill solid, and if it gets it done on time, Frist won't need to introduce anything," one GOP aide said.
Frist, while touring immigration detention centers Tuesday in Long Beach and Los Angeles, said he opposes giving illegal workers amnesty, but said it was too soon for him to take a position on a guestworker program, which is likely to be the most contentious component of an immigration bill and has divided Republicans. The House passed legislation last year toughening border security and requiring companies to verify the legal status of their employees. Unlike the House bill, the Senate bill is widely expected to include some version of a guestworker program. The program included in the Kennedy-McCain bill would allow illegal workers to join a temporary guestworker program, after which they could be eligible for permanent citizenship if they meet criteria and pay a fine. Under the Cornyn-Kyl plan, guestworkers ultimately would have to return to their home countries.-- by Emily Heil

Just Now, I received a call from congresswomen staff. She was able to get some standard response from NSC via congrees inquiry cell at NSC[she read for me]. Still 26000 application are pending NSC prior to July 17th filer. I asked again and again same question, How they can enter data for Aug first week before July 2nd. What about FIFO? She was repeating again and again what response she got from USCIS. I was able to get I-765 # from her. I asked her how come 765 (LIN#) is possible without 485 data[she don't understand inter-dependency of application]. Stange but something is better than nothing. I will write again for FIFO. I don't want USCIS actions go unnoticed. I will do my part.
I am happy congresswomen staff did some inquiry. I will post when i received copy of USCIS official reponse to congresswomen by post/email.
